Wairimu was accussed of killing her husband Cohen and dumping his body in a septic tank inside his compound.
In a ruling, Justice Daniel Ogembo allowed an application by the director of public prosecution Noordin Haji seeking to withdraw the ****** charges against Wairimu and her co-accused Peter Karanja and instead, substitute it with a public inquest.
However, Tob Cohen’s sister Gabriele Van Straten strongly opposed the withdrawal of the case by Haji, arguing that the family who are victims were not informed by the DPP that he was going to drop the case.

Ogembo directed that the case should proceed to a public inquest as requested by the DPP Haji.
The judge said that the DPP is independent and does not need to consult anyone on the decisions he takes.
"Court accepts DPP Noordin Haji’s withdrawal of ****** charges against Tob Cohen’s widow Sarah Wairimu; Justice Daniel Ogembo says Haji free to file an inquest," a local media house affirmed.
